HRSD seeks public feedback on domestic workers draft regulations

The Ministry of Human Resources and Social Development (HRSD) has opened a public consultation on the draft regulations for domestic workers and similar roles through the public consultation platform “Istitlaa”, with feedback accepted until April 28.

The draft will replace current regulations, aligning with labor market developments, improving sector practices, and reflecting regulatory and economic updates.

The draft defines the parties and domestic work contracts, requires documentation through the approved platform, mandates fixed-term contracts, and organizes a 90-day probation period, during which the employer can assess competence and conduct, and either party may terminate the contract unilaterally.

It sets 10 hours as the maximum daily work, with breaks of at least 30 minutes every five hours, continuous daily rest of at least 8 hours, and a full weekly rest day of at least 24 hours, with extra pay for overtime.

The draft provides 30 days of annual leave upon contract renewal after two years, sick leave up to 30 days under defined conditions, and an end-of-service gratuity of one month’s pay for every four consecutive years.

It prohibits employing anyone under 21, forbids retaining the worker’s passport, and requires the employer to cover recruitment, accommodation, healthcare, and return tickets in specified cases.

The regulations cap wage deductions at 25%, set contract termination rules for both parties, provide up to two months’ pay for unlawful termination, and allow disputes to be resolved amicably through the Ministry before referral to labor courts, with the Ministry authorized to enforce compliance and apply penalties under labor law.
